A premises liability lawsuit is initiated after an owner of a building or property fails to properly maintain the premises for the safety of those who enter the premises and results in the injury of someone who either works on the premises or is visiting. A premises liability lawsuit can be initiated against anyone, including private individuals, if it can be proven that their negligence in maintaining the property resulted in damages such as an injury.
Workers can initiate a premises liability lawsuit against their employer if the employer fails to maintain a safe workplace. If the employer is negligent in maintaining the premises and does not provide a safe place for employees to work that results in a workplace injury, it can result in a premises liability lawsuit. An example of this would be an employer who exposed employees to toxins without informing them, one that had faulty maintenance of the building such as beams falling down on employees.
