Cerebral Palsy-Special Needs Trust

At The Law Office of Zucker & Bennett, P.C., we've created Special Needs Trusts or Supplemental Needs Trusts for children we've represented with cerebral palsy or with other devastating type injuries. This trust will allow children to remain eligible for Medicaid benefits.

MR. GARY ZUCKER: We've created Special Needs Trusts or Supplemental Needs Trusts for children we've represented with Cerebral Palsy or with other devastating type injuries. What this allows us to do, and this is permitted by law, is to take the settlement monies, put it into that trust and that money can now be used for the child for any purpose during the child's lifetime. But it allows the child to remain eligible to receive Medicaid benefits. Without these trusts, then the child would lose Medicaid eligibility and whatever money was recovered in the law suit would simply be going to pay for those medical expenses that Medicaid previously paid for.
