MR. ZUCKER: Workers who are injured on the job are entitled under the Workers Compensation Law to be compensated for their injuries, for their lost earnings, to have all their medical expenses paid, regardless of fault. The only issue being if someone is injured in the course of their employment. The law however does not limit the injured worker to recovering workers compensation where there is a third party that may be responsible for the injury. In products liability cases a worker may be injured in the course of his employment by a defective appliance or a defective machine that he's operating. That worker has the right to receive workers compensation benefits and in addition that worker has the right to bring a lawsuit against the manufacturer of the machine if he can prove that the machine was at fault in causing his injury.
