MR. ZUCKER: Wrongful death is where, as it implies, someone dies as a result of the negligence of some other individual or institution. Over the years I've handled many wrongful death cases and at any given time I'm handling many wrongful death cases. I think the juries appreciate that this type of case, a death, is the ultimate injury. Unfortunately, in New York we have a very harsh wrongful death statute. New York was one of only 13 states that did not permit recovery for the emotional or psychological loss of a loved one. So we have been successful in maximizing the recoveries under this harsh statute, and we hope to get that changed, and I know that—I'm a member of the New York State Trial Lawyers Association and the Trial Lawyers Association is lobbying the legislature and the governor to try to get this law changed and hopefully one day we will get it changed.
